These Terms & Conditions govern your use of the Newlina Jewellery website and your purchase of products from our online store. By accessing our website or placing an order, you agree to be bound by the terms set out below.
Throughout these Terms, “we”, “us”, and “our” refer to Newlina Jewellery.
1. General
1.1 This website is operated by Newlina Jewellery. By using our website, you are deemed to have read, understood, and agreed to these Terms & Conditions.
1.2 These Terms incorporate our Privacy Policy and Refund & Returns Policy, which form part of the agreement between you and Newlina Jewellery.
1.3 We may update or amend these Terms & Conditions at any time. Any changes will apply to future orders placed after the date of publication.
2. Online Orders
2.1 We take reasonable care to ensure that all product details, descriptions, and prices shown on the website are correct at the time they are entered into our system.
2.2 We aim to display product colours, textures, and finishes as accurately as possible; however, variations may occur due to monitor settings. As all pieces are individually handmade, the item you receive may differ slightly from the examples shown.
2.3 We may be unable to accept an order for reasons including (but not limited to):
- The item is out of stock
- Payment authorisation failure or suspected fraud
- Pricing or description errors
- Technical or system failure
- Failure to pass customer validation checks
2.4 When you place an order, you will receive an email confirming the order details. This email acknowledges your order but does not constitute acceptance.
3. Payments
3.1 Payments are processed securely through PayPal. You may also pay using a debit or credit card via the checkout page.
3.2 Once payment is received, you will receive confirmation. A binding contract between you and Newlina Jewellery exists only when your order has been accepted, processed, and dispatched.
3.3 Your statutory rights are not affected.
4. Delivery
4.1 At checkout, you will be shown available delivery options. Any delivery times provided are estimates only and may be subject to delays beyond our control, such as courier issues or peak trading periods.
4.2 If you select a “Special Delivery” option (where available), this may reduce the delivery timeframe, but it does not guarantee next-day dispatch. As all items are handmade, production time may still be required. We will prioritise orders where Special Delivery has been selected and paid for.
5. Order Cancellation & Returns
5.1 If you wish to cancel an order, please contact us immediately to check whether it has been dispatched.
5.2 Items may be returned or exchanged within 14 days of receipt, provided they are:
- Unworn
- In original condition
- Returned with original packaging
- Accompanied by proof of purchase
5.3 The following items are non-returnable:
- Personalised or custom-made items
- Earrings (for hygiene reasons)
5.4 You must contact us before returning any item. Always obtain proof of posting, as refunds cannot be issued until the returned item is received.
5.5 Return postage is the customer’s responsibility unless the item is faulty. If the item is confirmed as faulty, postage costs will be refunded.
5.6 For international returns, any customs fees or import duties incurred are the customer’s responsibility and will be deducted from the refund.
6. Liability
6.1 Newlina Jewellery is not liable for any indirect, special, incidental, or consequential damages, including loss of profit or opportunity, arising from the use or inability to use any products purchased.
6.2 Nothing in these Terms limits your rights under the Consumer Rights Act 2015, nor excludes our liability for:
- Faulty or misdescribed goods
- Death or personal injury caused by our negligence
- Fraud or fraudulent misrepresentation
7. Indemnity
7.1 You agree to indemnify us on demand against all claims, liabilities, damages, costs, and expenses (including legal fees) arising from your breach of these Terms & Conditions.
8. Intellectual Property
8.1 All content on this website, including photographs, images, designs, and logos, is the copyright, trademark, or registered trademark of Newlina Jewellery or its respective owners. Content may not be reproduced without prior written permission.
9. Events Outside Our Control
9.1 We will not be responsible for any failure to fulfil our obligations where such failure is caused by events beyond our reasonable control, including but not limited to natural disasters, technical failures, or courier delays.
10. Jurisdiction
10.1 These Terms & Conditions are governed by the laws of England.
10.2 Any disputes arising from these Terms will be subject to the exclusive jurisdiction of the courts of England & Wales.
11. Entire Agreement
11.1 These Terms & Conditions constitute the entire agreement between you and Newlina Jewellery and supersede any prior understandings or agreements.
